These Terms & Services govern all services provided by Greenheart Landscapes, a Tempe-based residential landscape design-build company serving homeowners throughout the Phoenix East Valley and surrounding communities.

By approving an estimate, signing a proposal, approving a design, or submitting payment, the client agrees to these terms in full.

Greenheart Landscapes provides custom landscape design, outdoor living construction, hardscape, concrete, masonry, irrigation, landscape lighting, pergola, barbecue area, and related residential landscape improvement services in Tempe, Scottsdale, Chandler, Gilbert, Paradise Valley, Mesa, Phoenix, Ahwatukee, and surrounding areas.

All work is performed according to the approved written scope, applicable Arizona requirements, local municipal standards, HOA requirements when applicable, and standard residential landscape construction practices.

2. Scope of Services

Greenheart Landscapes provides professional landscape design-build and outdoor living services throughout the Phoenix East Valley, including:

• Travertine Installation
• Pavers Installation
• Artificial Grass Installation
• Barbecue Area
• Pergola Installation 
• Pool Deck Resurfacing 
• Retaining Walls
• Concrete Contractor Services
• Landscape Lighting Design
• Irrigation Systems

Only the services specifically described in the signed written proposal are included in the scope of work. Any additional work must be approved through a written change order.

3. Estimates & Pricing

All estimates are provided in writing and are valid for the period stated in the proposal.

Pricing may be adjusted if:

• Material costs increase
• Scope changes occur
• Unforeseen site conditions arise
• Permit or HOA requirements change

Permit fees and HOA fees are not included unless stated in writing.

4. Deposits & Payment Terms

A deposit is required to secure scheduling and materials.

Payment schedules will be outlined in the signed contract and may include deposit, progress payments, and final payment upon substantial completion.

Failure to make timely payments may result in project suspension and enforcement of lien rights under Arizona law.

5. Change Orders

 Any changes to the original scope must be documented in a written change order signed by both parties.

Change orders may affect cost, materials, and timeline.

Verbal requests are not binding.

6. Project Scheduling & Delays

Project timelines are estimates only.

Delays may result from:

• Weather, including Arizona monsoons and extreme heat
• Material shortages
• HOA approval timelines
• Permit processing
• Utility conflicts
• Acts of God

Greenheart Landscapes is not liable for delays beyond its reasonable control.

7. Permits & HOA Approvals

Homeowners are responsible for securing HOA approval unless otherwise agreed in writing.

Permit responsibilities will be specified in the contract.

Delays caused by municipal review or HOA processes are outside the contractor’s control. Redesign requirements may result in additional charges.

8. Site Conditions & Underground Utilities

Clients must disclose all known site conditions, including:

• Underground utilities
• Irrigation systems
• Drainage concerns
• Soil instability
• Gas lines
• Electrical lines
• Low-voltage wiring
• Plumbing lines
• Pool equipment lines
• Sewer lines
• Septic components
• Private drainage systems
• Previous construction or abandoned utility lines

Public utility marking may be required prior to excavation. Public utility marking does not always identify private lines, irrigation lines, landscape lighting wires, pool equipment lines, drainage lines, or homeowner-installed systems.

Greenheart Landscapes is not responsible for damage to unmarked utilities, undisclosed irrigation lines, concealed drainage systems, abandoned lines, improperly installed systems, or private underground utilities.

Unforeseen conditions may require additional work at additional cost.

9. Material & Installation Disclosures

Certain material characteristics are inherent and not considered defects.

Natural stone and travertine may vary in color, veining, and texture. Concrete pavers may vary in shade and may develop efflorescence. Minor settlement may occur due to expansive Arizona soils.

Artificial grass may retain heat during high-temperature months. Surface temperature differences are inherent material characteristics.

Outdoor kitchens include appliances covered solely by manufacturer warranties. Stainless steel and exterior components are subject to weather exposure.

Landscape lighting systems may experience voltage variations depending on transformer capacity and load distribution.

Drainage improvements reduce water accumulation but cannot eliminate all standing water during heavy rainfall or monsoon events.

10. Warranty Information

Greenheart Landscapes may provide a limited workmanship warranty as defined in the signed agreement.

Manufacturer warranties apply to materials including artificial turf, pavers, travertine, lighting fixtures, and appliances.

Warranty does not cover:

• Normal wear and tear
• Improper maintenance
• Third-party alterations
• Soil movement outside installed areas
• Weather-related damage
• Acts of God

Warranty claims must be submitted in writing.

11. Limitation of Liability

Greenheart Landscapes shall not be liable for indirect, incidental, special, punitive, or consequential damages.

Liability is limited to the total contract value of the specific work performed.

The company is not responsible for:

• Pre-existing drainage issues
• Undisclosed site conditions
• Turf heat retention
• Natural material variation
• Manufacturer defects
• Electrical voltage fluctuations

12. Customer Responsibilities

The client agrees to:

• Provide safe access to the project site
• Remove personal property from work areas
• Secure pets during construction
• Maintain irrigation and installed systems after completion
• Provide accurate site disclosures

Failure to meet these responsibilities may delay the project and may result in additional charges.

13. Cancellations & Refund Policy

Deposits are non-refundable once materials are ordered or scheduling is confirmed.

Custom or special-order materials are non-refundable.

Cancellation after procurement may result in restocking or handling fees.

14. SMS Communications

By providing your phone number to Greenheart Landscapes, you consent to receive SMS communications related to your inquiry or project. These messages may include appointment confirmations, scheduling updates, project notifications, and occasional service-related follow-ups. Greenheart Landscapes does not send unsolicited promotional messages without consent.

• To stop receiving messages, reply STOP to any text message.
• Message and data rates may apply. Check with your carrier for details.
• Carriers are not liable for delayed or undelivered messages.
• You must be 18 years of age or older to use this SMS service.

15. Dispute Resolution

The parties agree to attempt good-faith resolution prior to legal action.

If a concern arises, the client agrees to submit the concern in writing and provide Greenheart Landscapes a reasonable opportunity to inspect, review, and address the matter.

If unresolved, disputes shall be subject to jurisdiction in Maricopa County, Arizona, unless otherwise required by law.

Mediation may be pursued prior to litigation when appropriate.

16. Intellectual Property

All design plans, drawings, renderings, layouts, concepts, written recommendations, proposals, photos, and project documents remain the property of Greenheart Landscapes until full payment is received.

Unauthorized reproduction or use is prohibited.

Clients may not copy, distribute, sell, transfer, or provide Greenheart Landscapes’ designs to another contractor for bidding, construction, or reproduction without written permission.

17. Governing Law

These Terms & Services are governed by the laws of the State of Arizona and applicable state and local requirements.
